Code of Conduct for
Korea Environmental Council in Europe |

|
In the European Union,
lobbying is recognised as a legitimate means of
access to parliamentary, government and municipal
institutions at the European Union as well as
Member States level and it is in the interest of
the public to know who is attempting to influence
such institutions.
In order to foster
transparency in and the proper conduct of
activities, this Code of Conduct for the Korea
Environmental Council in Europe (hereinafter, KECE)
provides standards to govern staffs of KECE in the
course of lobbying activities, which activities
may contribute to informed decision-making by the
European policy- and law-making bodies.
This Code of Conduct
aims at contributing to the preservation and
enhancement of the confidence in Members of KECE
and the European decision-making bodies.

CHAPTER I -
OBJECTIVE |
Article 1
The objective of this
Code is to establish standards of conduct for KECE
staffs in order to ensure that lobbying activities
are properly conducted and to foster transparency in
the lobbying of the European decision-making bodies. |

CHAPTER II -
PRINCIPLES |
|
Article 2
(Integrity and Honesty)
(i) KECE staffs
should conduct with integrity and honesty all
relations with decision-making bodies, members,
employers, the public and other lobbyists.
(ii) KECE staffs
should discharge the obligations pertaining to
their lobbying activities and conduct such
activities with honesty and integrity.
(iii) KECE staffs
should refrain from making false or deceptive
representations to a decision-making body and
from intentionally misleading anyone.
(iv) KECE staffs
should not induce any person to contravene the
standards of conduct applicable to him or her. |

Article 3
(Openness)
KECE staffs should,
at all times, be open and frank about their
lobbying activities, while respecting
confidentiality. |
|
Article 4
(Professionalism)
KECE staffs should
observe the highest professional and ethical
standards. In line with Articles stipulated in
CHAPTER III of this Code of Conduct, KECE staffs
should conform fully with not only the letter
but the spirit of this Code of Conduct as well
as all the relevant laws and regulations. |

Article 5
(Transparency)
(i) Identity and
purpose: KECE staffs should, when making a
representation to a decision-making body,
disclose the identity of the person or
organisation on whose behalf the representation
is made, as well as the reasons for the
approach.
(ii) accurate
information: KECE should provide information
that is accurate and factual to public office
holders. Moreover, KECE staffs should not
knowingly mislead anyone and shall use proper
care to avoid doing so inadvertently.
(iii) disclosure
of obligations: KECE staffs should indicate
to their Members, employer or organisation their
obligations to adhere to this Code of Conduct. |

Article 6
(Confidentiality)
(i) confidential
information: KECE staffs shall not divulge
confidential information unless they have
obtained the informed consent of the Member or
organisation concerned, or disclosure is
required by law.
(ii) Insider
information: KECE staffs shall not use any
confidential or other insider information
obtained in the course of their lobbying
activities to the disadvantage of the Members or
organisation concerned. |

Article 7
(Conflict of Interest)
(i) competing
interests: KECE staffs should not represent
conflicting or competing interests without the
informed consent of those whose interests are
involved.
(ii) disclosure:
KECE staffs should advise decision-making bodies
that they have informed the Members of any
actual, potential or apparent conflict of
interest, and obtained the informed consent of
each Member concerned before proceeding or
continuing with the undertaking. |

CHAPTER III
PROFESSIONALISM |
|
Article 8
(General Provision)
In carrying on
lobbying activities, KECE staffs should be
respectful of parliamentary, government and
municipal institutions and of other
decision-making bodies. They should also respect
the right to equal access to those institutions. |
|
Article 9
(Representation)
KECE staffs should
foster, among the public and through their
professional dealings, a good understanding of
their activities and of the legitimacy of such
activities. In addition, they shall refrain from
acting in any manner that may discredit KECE
activities. |

Article 10
(Notification to Members)
KECE staffs should
inform the Member or organisation those whose
interests they are representing, of their duties
and obligations under this Code of Conduct. |

Article 11
(Communication)
When they
communicate with a decision-making body, KECE
staffs should specify the identify of the Member
or organisation whose interests they are
representing as well as the purpose of the
communication. |
|
Article 12
(Disclosure)
KECE staffs should
not, by any means whatsoever, conceal or try to
conceal the identity of the Member or
organisation whose interests they are
representing. |
|
Article 13
(Accountability)
KECE staffs should
be diligent, cooperative and accountable in
their relations with the decision-making bodies
as well as Members. |
|

CHAPTER IV
FINAL PROVISIONS |
Article 14
Disciplinary measures
and penalties may be imposed on a KECE staff in the
event of a breach or infringement of this Code of
Conduct. |

Article 15
This Code of Conduct
comes into force on 1 September 2006. |
